Terms of Service

These Terms of Service ("Terms") govern access to the Beamtune website, platform, public AI assistant pages, and related services (collectively, the "Service"). If you use the Service, you agree to these Terms.
1. Who We Are
Beamtune is operated by Individual Entrepreneur Boris Zubarev. Questions about these Terms, billing, or legal requests can be sent to support@beamtune.ai.
2. Eligibility
You must be at least 16 years old to use the Service.
If we reasonably determine that an account is being used by someone under 16, we may suspend access and delete associated data under the retention and legal-hold framework described in our Privacy Policy.
3. Service Description
Beamtune enables creators to publish AI assistants based on their own content so visitors can ask questions, receive AI-generated responses, and review cited source material. Users are informed no later than their first interaction that they are chatting with an AI assistant and receiving AI-generated responses.
The Service is a software product. Paid plans cover access to hosted software features only and do not include consulting, implementation services, managed services, or other human-delivered services.
4. AI Use and Accuracy
AI-generated responses may be incomplete, incorrect, or out of date. You remain responsible for evaluating any response before relying on it.
The Service is not a substitute for licensed professional judgment. Requests for regulated advice, including medical, legal, financial, investment, or other high-risk professional advice, may be refused or otherwise restricted by platform guardrails.
5. Creator Content and Conversation Content
Creators keep ownership of the content they connect or upload. You grant Beamtune a limited right to host, index, and process that content solely to operate the Service.
We do not use creator content, conversation content, or personal data to train general-purpose AI models.
Conversation content is processed to deliver the Service, maintain conversation history, improve operational reliability, and enforce platform safety and abuse controls.
6. Acceptable Use
You may not use the Service to:
- Upload or index content you do not have the right to use.
- Impersonate another person or misrepresent affiliation.
- Generate harmful, abusive, illegal, or deceptive content.
- Use the Service to provide regulated professional advice without authorization.
- Probe, scrape, reverse-engineer, or interfere with the Service.
- Attempt to bypass safety controls, refusal logic, or account restrictions.
7. Pricing, Billing, and Refunds
Public plan details are published at /pricing. Paid subscriptions renew on a recurring basis unless cancelled before the next renewal date.
Cancellation stops future renewals at the end of the current billing period. Cancellation does not automatically trigger a refund. Refund requests are handled under our Refund Policy.
We do not currently use an external merchant-of-record payment processor. If external payment processing is introduced later, we will update these Terms, the Refund Policy, and the public subprocessor register before that processing becomes active.
Free pre-sales communications, including intro calls, and support communications do not create a consulting or managed-services engagement unless both sides sign a separate written agreement.
8. Third-Party Providers
We use third-party providers to operate the Service, including infrastructure, billing, authentication, transactional email, and AI inference services. Our current public register is available at /subprocessors.
9. Availability and Changes
We may modify, improve, or discontinue parts of the Service from time to time. Where a change materially affects legal or billing expectations, we will update the relevant public policy pages at their canonical URLs.
10. Termination
You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms, create material legal or security risk, or use the Service in a way that harms others or the platform.
11. Liability
To the maximum extent permitted by applicable law, Beamtune is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
Nothing in these Terms excludes liability that cannot be excluded by applicable law, including mandatory consumer protections.
12. Disputes
Before starting formal proceedings, both sides will try to resolve disputes in good faith by contacting the other party and allowing a reasonable period to respond.
These Terms do not override mandatory consumer rights, statutory remedies, or mandatory forum protections that apply in your jurisdiction. Jurisdiction-specific consumer addenda may apply where local law requires them.
13. Changes to These Terms
We may update these Terms from time to time. Material changes will be published at this canonical URL and reflected across the public legal package before or when they take effect, except where urgent legal or security changes require immediate effect.
